Happy Birthday Gabriel!

The irony of Second Life: as it gets bigger, my opportunities shrink
Today, an editorial of sorts: an examination of how there's actually less and less for me to do in Second Life, the bigger the place grows and the more tech is needed to adequately run it all. Why yes, it's very frustrating, especially when unemployed and unable to upgrade my system. I wish Linden would do something about it, which is the thrust of this entry.

[studie] Europe in figures. Eurostat yearbook 2008

[studie] Economic Growth and Subjective Well-Being
The “Easterlin paradox” suggests that there is no link between a society’s economic development and its average level of happiness. Betsey Stevenson and Justin Wolfers re-assess this paradox analyzing multiple rich datasets spanning many decades. Using recent data on a broader array of countries, they establish a clear positive link between average levels of subjective well-being and GDP per capita across countries, and find no evidence of a satiation point beyond which wealthier countries have no further increases in subjective well-being. The two authors show that the estimated relationship is consistent across many datasets and is similar to the relationship between subject well-being and income observed within countries. Finally, examining the relationship between changes in subjective well-being and income over time within countries Stevenson and Wolfers find economic growth associated with rising happiness. Together these findings indicate a clear role for absolute income and a more limited role for relative income comparisons in determining happiness.

[nieuwsberichten] Grootste bevolkingstoename sinds 1965

LIVE Feed!

We also provide simulator software for the Mac, the iPhone/iPod touch and other platforms that receives and displays live broadcasts of our animations being shown on Stereoscope in real time. This way you can watch Stereoscope from everywhere on the planet. Nice 3D graphics and simple interaction make the iPhone application especially useful. The iPhone application will be available soon from the iTunes App Store.

iTunes-2.jpgiTunes-3.jpg

By Felix Tero

Snorkeling is a laidback form of scuba diving that requires only basic scuba equipment and minimal skills. Beautiful coral formations and amazing fish species still dot the shallow waters, so there’s really no stopping you from basking in the scenery and viewing marine life close to the surface with the use of a snorkel. By choosing the right scuba equipment to support your underwater pursuit, snorkeling may just be one of the best experiences of your vacation.

The Scuba Equipment You Need

Diving Mask. This device allows you to view underwater sceneries without the water straining or irritating your eyes. Choose one that fits your face well. Likewise, adjust the strap in such a way that it won’t strain your cheeks after some time. There are two-in-one (mask and snorkel) packages, such as the H2Odyssey MS-12 and SS-12 Mask and Snorkel Combo for adults and H2Odyssey Junior PVC Mask and Snorkel Combo for children, that will prove to be an economical and excellent companion for your snorkeling activities and trips to the beach with your family.

Swim fins. Your purchase of swim fins or diving fins will be dependent on your location and how often you intend to engage in snorkeling. If you want to swim longer distances and view coral reefs, investing on a pair of paddle fins will help enhance your snorkeling experience. For one, it will aid movement and increase fluidity. Moreover, swim fins will help you counter drag that limits your flexibility.

Wetsuit. In view of the activity’s depth profile, a 2mm wetsuit (fullsuit) would suffice–even shorties will do, to keep you warm, protect you from the rays of the sun and against underwater abrasion as well. Nonetheless, if you want to snorkel in freshwater locations that may be cooler in temperature, it is advisable to use farmer-john style (two-piece) wetsuits while snorkeling.

Snorkel. Of course, you can’t get into snorkeling without your snorkel. The device allows you to breathe underwater and remain at a shallow depth to enjoy the underwater scenery. Some diving masks may already be outfitted with a snorkel, so choose one that is light enough for you to carry along on trips. Also, choose a snorkel with minimal strap attachments to avert the risk of entangling the device with other scuba equipment.

The Fun in Snorkeling

Going with the flow. Scuba diving trips may present opportunities for drift diving near the surface of the water. In this case, the use of a snorkel is a more practical option if you intend to remain submerged while cruising along with the flow of the current.

Sports underwater. Some sports such as underwater hockey and bog snorkeling can be played under the pool.

Snorkeling can be performed anywhere. You can actually snorkel anywhere and experience what life really is in various underwater locations such as freshwater lakes, rivers, tropical beaches and marine habitats.

I read this post in The Age Newspaper: Google backs down over browser amid privacy concerns. I promptly uninstalled my Chrome browser, and went back to my faithful Firefox. If you have memories of the Kansas City Barbeque in San Diego, you have certainly been told by now that a fire gutted the building Thursday.  From SD Union-Tribune:

The fire broke out about 2:15 p.m. in the restaurant on West Market Street, located across the street from the Manchester Grand Hyatt hotel towers and near Seaport Village. It initially created so much smoke that clouds of it could be seen billowing behind Petco Park, where the Padres were playing an afternoon baseball game.

But (assuming you’ve been there) remember the memorabilia that lined the ceiling and walls?  What if you could be a part of re-building that much of the KC BBQ?  Because if you have not heard the great news, Martin & Cindy are rebuilding.

cruise hats

Let’s Restock the KC BBQ.  Do you have a cap from your ship or squadron, an old picture of friends in the barbeque?  Why not take part in restoring the KC BBQ.  What kind of place would it be without the ton of little things that created the physical atmosphere.

Here is the location/contact information for KC barbeque in the interim, but I’ll try to contact Martin & Cindy to see how we can help, and just where we can deliver “Restock the KC BBQ” items.

Stay tuned (and start checking your closets and attic for what you’ll send) and if you have a memory of the Kansas City Barbeque, please share it (as well as anything helpful to the Restock effort) in the comments below.

If you like Twitter, but wish there was an app out there to allow you to tweet from you cell, look no further.  Web Worker Daily comes through again, and shows us just the ticket:

“On my Windows Mobile phone the interface is crisp and clean and Twhirl like.  I can see and browse through my timeline and tweet, reply or direct message easily. Options let me choose how often it checks for updates which is great with the ever changing API limits that Twitter seems to be imposing.”

Pre-Installed OpenOffice | alternative to MS Works & MS Office

Provide OpenOffice.org for free pre-installation alongside Microsoft Works and Microsoft Office. OpenOffice.org is more capable than Microsoft Works, and a serious competitor to Microsoft Office, at a fraction of the cost (it's free!)

OpenOffice.org can open, create, edit and save Microsoft Word, Excel and PowerPoint files.

Provide as OPTIONS for pre-installation many other high-quality free software programs such as:

- Firefox: web browser with popup and privacy controls; say goodbye to Internet Explorer infections!

- Thunderbird: email program with free anti-spam and privacy controls

- Pidgin: instant messaging all-in-one program for popup-free MSN, Yahoo, AOL and others
&nsbp;[ed: GAIM was renamed Pidgin in April 2007 to settle the issue with AOL's trademark on AIM]

- PDFCreator: creates Adobe PDF files from any program

- Scribus, Inkscape & GIMP: desktop publishing, freehand drawing & powerful image editing

- Audacity & VLC: multi-track audio editing & universal all-in-one media/video/movie/DVD player
- Stellarium & Celestia: planetarium viewer & outer-space mapping, like Google Earth, but for our Solar System

Pre-installed quality free and open source software drastically lowers the cost of new PCs, and helps prevent software piracy. Cast your vote for Linux and other free software. Cast your vote for the Universal Education PC [ed: article removed/merged by dell_admin] utilizing free software.

CHOICE is what consumers want on their new PCs, not annoying surprise circus-ware (the typical smattering of confusing 3rd party popup-infested software found on most new Dell PCs). Quality free and open source software is well behaved, and may be legally pre-installed on PCs, and legally shared with friends and family, sharing is encouraged! Cast your vote for consumer CHOICE and public transparency at Dell

Dell is constantly reviewing options to offer to customers. As this is available for free today, we do not currently plan on offering this as an option to factory install.

Sailing can offer one of the most liberating experiences in the world. However, there are not many people that know how to sail properly and this is why the Internet can be so useful. For them, there are specialized companies providing yachts for rent and training programs, all at low-cost prices.

Fractional Sailing Program has offered interested customers the possibility to cruise with a luxurious yacht, paying only a part of the possession. Many clients have proved out to be interested, considering such programs as innovative and attractive. It represents a great alternative to owning a yacht, especially as a lot of people still dream of owning one.

Sailing with a beautiful yacht can transform from a dream into a true reality with the help of the fractional sailing program. They have really conveniable offers, providing intensive training sessions for beginners and showing their commitment throughtout the entire sailing season. They have a flexibile program, allowing the client 7 uses per month and additional uses if there are any yachts available, at no extra cost.

There are many benefits to fractional sailing and the price is not the biggest advantage. They have Catalina sailyachts just waiting to take you sailing in the local waterways, equipped with all the things needed, meaning safety items, cookware and high-tech electronics. A permanent, wireless Internet connection maintains a permanent communication with the shore, making sure that everything is working out just fine.

Their check-in and check-out system is wisely devised, so as the company and also the client are satisfied. They have the ability to constanly monitor the yacht and alert the proper authorities in case something goes wrong. Also, the staff is warned about fuel, pumping or maintenance requirements.

The member program for fractional sailing includes training lessons for those who want to learn how to sail. The complete training program is designed to make an introduction to navigation and develop all the necessary skills, allowing clients in the future to sail out on their own. The program has flexible payment options and a big plus is represented by the fact that training is for free.

If one were to weigh the possibility of owning a yacht and the one regarding the fractional sailing program, the final results were surely in favor of the second. There are no additional charges, no maintenance worries and no insurance policy to pay. However, clients are responsible for any damages and they also have to do the cleaning after the rental period expires.

For those who want to learn how to sail, there are a few things that should be known. First of all, the type of training depends very much upon the location. There are intensive courses which last up to three days but it will take a lot more to learn the true art of sailing. The basic stuff taught includes sailing orientation, yacht terminology and vital information about safety equipment. Life vests, flotation items and navigation elements should be present at all times and clients should learn how to use them properly.

There is also the owner member program, very interesting when you come to think about it. You buy a yacht, you introduce it in the program and enjoy a great period of sailing without thinking about any other details. After the agreement expires, you have several options to choose from. You can, of course, keep the yacht, sell it or exchange it with a new one. Whatever you pick out, you can be sure that you are dealing only with professionals, trained to serve and assist you.

There can be said a lot of things about sailing. The most important and certain thing is that it is just as popular today as it was centuries ago. The reasons for why we sail may have changed, but there are still some common elements. More and more people opt for fractional sailing, being attracted by the member programs and fair prices, welcoming also the possibility to be trained into the art of sailing.

This is how I got rid of Antivirus XP 2008. It is different than the XP Antivirus 2008 most sites refer to.

This is here more as a reminder for me than anything else. That post was not at the top of my search results, and I can change that by only searching here. If you are trying to clean up AvXP2k8, you should go to that forum post and follow those instructions. There are other posts in the thread, but this was the one that worked for me. As always, your mileage may vary, so I am not liable for anything you do to your computer.

At least the user had the good sense to immediately report it, rather than try to self-fix the situation. Also, thanks to co-worker Matt Bussey for his assistance in researching the situation.

Antivirus XP 2008 Malware Wave Continues

The Panda US Security Blog reports that the crooks behind Antivirus XP 2008 are using faked CNN News Alert e-mails to send people to malware infector sites, where people are told to download a new codec to view the alert. This codec turns out to be Antivirus XP 2008. It also shows up as a fake update to IE 7.

In my dealings with the product, I find that some users are getting it from e-mailed spam messages, while others are picking it up from sites they found during Web searches. I’ve been wondering if a plain-text e-mail system would help, but it certainly could not hurt.

Bill Mullins notes that the next version, Antivirus XP 2009, is already out. I cannot vouch for his recommended products or sites, since I have not heard of any of them. Use them at your own risk. However, his general synopsis of the malicious fake security software is accurate.

Surprisingly, having ultra-tight settings in IE7 did not seem to prevent installation. I’d be interested in learning whether Firefox-using networks and Opera-using networks are also having problems with this software popping up. In the meantime, use common sense: avoid going to questionable sites, don’t open e-mail or IM messages from people you do not know, don’t open unexpected attachments, and call your local support staff immediately if you get a strange browser pop-up message about antivirus or antispyware or other security software. If your local support is your neighbor’s 13 year-old, turn the computer off and then call him after school.

Recently, my traveling laptop’s 512 MB of RAM proved inadequate for my use, so I purchased a replacement. The replacement came with Windows Vista and a load of garbage software–shame on you, HP–that made it almost unusable. In an effort to salvage my investment, I installed Mepis Linux 64-bit on part of the hard drive. However, neither the 64-bit version, nor the 32-bit version was able to pick up the built-in Atheros WiFi card, nor utilize the USB-plugged D-Link WUA-1340 I purchased in an attempt to make it work.

Enter Ubuntu. Using the 32-bit LiveCD, it immediately picked up the external adapter, and was able to connect to the hotel’s WiFi. I flattened Mepis and installed Ubuntu. I will give myself some time using the new system first, but I will probably flatten Vista and rid myself of that headache.

I realize that Microsoft is running taste-test ads in which XP users try Vista and are pleasantly surprised. I also realize that SP1 does fix many of the most pernicious problems with Vista, including many of the built-in drivers that could not be used, because they lacked required security information. As a traveler who spends up to two-thirds of my time using hotel networks, Vista’s continuing wireless weaknesses make it entirely too unreliable for my uses. I cannot recommend Vista to anyone who connects to multiple networks. It is just not good enough.

I think that those taste-testers would have been even more certain that Vista is a flop had they used it for an extended period, for their regular day-to-day uses, on standard hardware. I intentionally bought a computer with extra RAM and found that it really did help speed the system up, but it did little to make it usable.

I Am Looking for Online Payday Loan Websites
Many people will ask themselves where to look for online payday loan websites. Can they get a payday loan online?
by Ethan Hunter

Many people will ask themselves where to look for online payday loan websites. Can they get a payday loan online?

Well, they certainly exist - and yes, you probably can get a payday loan online, with no credit check and very little hassle. That’s the beauty of the internet - you can do almost everything!

So when it comes to payday loans, you probably want to know what type of sites are available and where they can be found.

That Burning Question:

How Do I Find Payday Loan Websites?

As you will discover, finding these websites is extremely easy. Unfortunately, while some work, some are not worth your time. Therefore, if you are unsure which to use, do your homework first. After all, a number of qualified websites do exist but then, there are others simply trying to get your personal information.

When looking into a company, try to find some sort of seal or symbol from the BBB, or Better Business Bureau. Not all companies that are good will have this, mind you, but it’s one sign that they’re not bad.

When you’re searching for the answer to ‘I am looking for payday loan websites… are there any?’, remember to pay attention to fees and other charges they’re tacking on - while the interest rate might be lower than you might have expected, the fees bring your total payment up higher than you can afford.

What Happens With Payday Loans Online?

The nest thing that you may be wondering when you are looking for a payday loan website is what happens there?

With the question, “I am looking for payday loan websites, what should I expect?” that is actually a great question.

First, you would need to be approved to secure a payday loan online. That means filling out forms with specific personal information, along with information about your job and the amount of money you want to borrow. In fact, you might need to mail, fax, or scan some documentation of proof such as pay stubs.

Then, if you’re approved, the money will be dropped conveniently into your checking account - ready for your use, without hassle. If you don’t have a checking account, or don’t want to use it, you may be able to find a payday loan company that will send - or overnight - you a check. However, these are a bit more rare!

In Summary

Well, I do hope that I’ve answered your question ‘I am looking for online payday loan websites… where do I turn?’ and that you’re able to find the loan that’s right for you!

Your Customized Trading Strategy
The key here in forex trading is to be educated enough to be a professional trader. Automatic income generation through forex trading is not as difficult as people usually consider it to be.Anybody who is educated enough can participate in this type of investing and generate profits.
by william taylor

The key here in forex trading is to be educated enough to be a professional trader. Automatic income generation through forex trading is not as difficult as people usually consider it to be.Anybody who is educated enough can participate in this type of investing and generate profits.

You must be aware of the tools and strategies that can make the big difference for yourself. Let me share some of the important factors that might play an important role in documenting your success story as a forex trader. You can also make handsome income through such investments, but you must have the correct knowledge to do that.

Always remember that forex trading is an automatic income generation method but only for the educated traders. Therefore, it is very important for you to attain the right form of education. However, you must keep yourself away from the infomercial Forex riches classes, they may not be very helpful for the beginners.

You should also note that there are hundreds of such training courses and materials available in the market. Therefore, it definitely pays to shop around. Be careful or you will only end up spending lots of money with little or no return at all. Word of mouth recommendations are perhaps the best way to find the right training program regarding automatic income generation through currency trading.

Different Forex tools also play a very important role in determining the amount of profit in your venture. Some of these tools can even send you important trading signals through the email or SMS. Likewise, some tools are capable of sending you various buy and sell alerts. Most of these tools are software programs.

You can get these tools from your favorite Forex trading sites on the Internet. However, make sure that your decision should not be based only on the information that is provided by these tools. In order to make the best use of the automatic income generation method, you must also do a technical and fundamental analysis thoroughly in order to decide whether you should buy or sell or simply stand aside.

It is good that you are careful and are using tried and tested strategies, but at the same time, it is also important for you to develop your own personal trading strategy. It is, in fact, not very prudent to always rely on the suggestions of your broker. If you are capable enough, you must include your own personal game plan to ensure better automatic income generation.

Always remember that a Forex trading strategy cannot be something generic. And as a forex trader you must factor in a plan that will limit your losses. Last, but not the least, you also need to be very careful while you are setting up an account with a FOREX broker.

A third of new PCs being downgraded to XP, says metrics researcher

According to Devil Mountain Software Inc., which operates a community-based testing network, nearly 35% of the 3,000-plus PCs it examined had been downgraded from Vista to XP.

Given my own recent experience with Windows Vista, I can see why such a large chunk of buyers quickly UPgrade from Vista to XP. Personally, I finally completely wiped out Vista this weekend, replacing it with Ubuntu 8.04 AMD-64 desktop edition.

Actually, it happened this way: I was going to add Fedora 9 to the list of operating systems installed on the computer, so I burned Vista restore DVDs, deleted the restore partition, then proceeded to resize the existing Windows and Ubuntu partitions to make room for Fedora–from inside Windows. Bad move, because I wound up with an unbootable system. I could have let the Fedora installer try to sort things out, but I realized I wasn’t going to use the Vista installation again anyway, so I wiped it out. And if I decide to pass this laptop on to someone else, they can stick the Vista restore DVDs in and have the same miserable experience I did.

After the installation of Fedora, I went to do updates, but was unable to reach the Fedora update servers from Friday evening to Sunday, when I decided to blow away F9 during the Ubuntu (re-)installation. So, in a multi-step process, my HP Vista laptop became the HP Ubuntu laptop that I should have been able to get from the retail location where I bought the computer.

Last year, Devil Mountain benchmarked Vista and XP performance using other performance-testing tools and concluded that XP was much faster. [Devil Mountain Software CTO Craig] Barth said things haven’t changed since then. “Everything I’ve seen clearly shows me that Vista is an OS that should never have left the barn,” he noted.

Auditioning a supplier for pre-installed Linux computers? Let us know how it turns out for you. Do you know a site which keeps a reasonably up-to-date and reasonably complete list? I’m not talking about buying a Windows computer and installing Linux over it–I mean offering computers powered by GNU + Linux and completely free of the Windows tax.

Only a few years ago I remember starting to develop my business and being frustrated with the lack of broadband coverage in the area I was living in in Ireland, especially as some of the development programmes I was attending required me to download from the Internet large presentations and audio files.

In fact one programme where I was a member of the teaching faculty made the decision to scale back their programme from being a webinar to being a teleseminar as so many people had problems not just with the technology platform being used but with broadband access.

It was interesting therefore to hear Martha Rotter who spoke about the ‘Academy Mobile’ programme within Microsoft at Saturday’s PodCamp Ireland conference comment that the platform that they have enabled allows Microsoft employees to produce a podcast with just a phone call - just as we do for the ‘Talking HR’ new programme I am collaborating on with HR consultant Jon Ingham and my masterclasses for ‘Biz Growth Live’ both of which are recorded using a phone line and then.

Viviane Reding, EU Telecoms Commissioner responsible for Information Society and Media Social Networking in Europe comments that:

It is this Commission’s policy objective to achieve broadband Internet for all Europeans by 2010.

From 2003-2007 broadband use in the EU tripled to 36% of households.

However, 7% of the EU’s population are still not connected (increasing to 30% in rural areas). And there are significant differences between diferent countries from 100% of the population being able to access broadband in Denmark, Luxembourg and Belgium, yet only 40% of the population in Romania (25% in rural areas) can access broadband.

Under the EU Telecoms rules, the view is that broadband access is critical for social inclusiveness and they wish to ensure that ‘basic communication services of good quality are always available at an affordable price, even if the market does not provide them under normal commercial conditions.’

Use of the internet across the EU is reported to be at 4 per cent of EU households using the Iinternet, 36 per cent of which are on broadband (corresponding to 20% of the total EU population).

A report in the Spring of 2008 commented that almost 40 per cent of European citizens still do not send emails or know how to use search enginges such as Google. They reported that the percentage of what they termed ‘Internet illiterates’ ranges from 69 per cent in Romania to 13 per cent in Denmark and the Netherlands.

It’s easy for those of us who have access to the Internet and especialy broadband to forget that not everyone has equality of access.

This data is also great reminder that we need to understand our audience if we are making content, products and services available using the web and that we need to provide our content in a variety of forms, repackaging it not just to meet the preferred learning style of our audience but also taking into account thier ability to easily connect with your information.

I’ll be interested to see if the subject of broadband access is discussed in the ‘Organise, Activate and Influence Conference’ talking place on Saturday and facilitated by the European Commission in Ireland.

Traditional literacy challenges are now being replaced by digital illieracy challenges and surely it’s the responsibility of all our governments to ensure that the ‘digital divide’ brought about be lack of access to the Internet does not create disadvantage or even discrimination for the citizens of their nations?

On this week’s PodCamp Ireland podcast one of the subjects we covered was that of why and how you can track the effectiveness of your social media marketing programme.

I was interested to see that increasingly marketers in Ireland are moving their marketing budgets online with 56% of them committing over 10% of their overall spend to online marketing as reported in the 2008 Irish On Marketing Sentiment Survey conducted by AMAS with members of the Marketing Institute of Ireland.

And the primary reason for this? The ability to measure the effectiveness of online marketing programmes.

The survey was completed online by 268 marketers, 92% of whom were members of the MII during July and August of 2008.

TRENDS IN ONLINE MARKETING IN IRELAND

The survey reports that the most popular online marketing programmes are:

  • Email campaigns - implemented by 64% of companies
  • Search Engine Optimisation - implemented by 46% of companies
  • Banner Advertising - implemented by 41% of companies.

In the area of new media and mobile marketing the formats being explored included:

  • Audio and video e.g. podcasts by 15% of respondents
  • Blogs and social networking by 20% of the respondents
  • Mobile advertising by 10% of the respondents
  • Online PR by 28% of the respondents
  • Viral marketing by 12% of the respondents (though I am not sure I understand this statistic as viral marketing in itself is not a digital marketing platform).

Some 14% of the marketers surveyed reported that they do no online marketing (this was 30% in 2007).

The respondents also commented that some 47% had moved spend from direct mail to online and 44% had moved from the press to online campaigns.

WHY IRISH MARKETERS ARE MOVING BUDGETS ONLINE

The primary reason for online marketing and digital marketing programmes being used by marketers in Ireland were as follows:

  • Optimising reach - 93% of respondents reported this as being very important or important
  • Measuring responses - 91% of respondents reported this as being very important or important
  • Lower-cost marketing channel - 86% of respondents reported this as being very important or important
  • Targeting and segmenting the customer profile - 86% of respondents reported this as being very important or important.

I often get asked by businesses in the SME sector why they need to have a website or online marketing programme. I always reply that online and digital marketing strategies are not just for businesses who want to sell products online. This was borne out by the results of the survey where the Irish marketers surveyed said that only 22% of them implemented online programmes because they saw direct selling online as very important.

I am sure that the adoption of digital marketing strategies will continue to increase due to the lower cost of implementation when budgets are under pressure, increasing adoption of broadband with ComReg reporting that there are over 1 million subscriptions to broadband (approximately 20% being mobile broadband) as at June 2008 and the transparency and ease of tracking.

Though of course this doesn’t mean that every digital campaign we implement will be successful. It will however become increasingly a crowded place online and excellence in innovation, creativity, and execution along side integrating online and offline channels will be critical for success when marketing online.

Owning boats such as fishing boats, ski boats, or pontoon boats is the dream of many people. However, the current market prices for these boats are considered to be very expensive. Many companies prefer to sell the used boats that have already been rented for quite sometime.

They usually keep a large stock of these boats and they are almost always readily available for sale. Some of the companies offer new rental boats for sale. These boats are sold at the end of each season well below the dealer\’ price. This sometimes ensures that the customer gets a brand new current year model for a considerably less than the market price. This can be a particularly good option in the event the customer prefers a luxury model.

The website http://www.unitedyacht.com/yachts.php?new=1 provides a list of a variety of rental boats put up for sale. This list provides all the details relating to them such as company, boat, style, and retail price in 2007, as well as the demo day price. Forums and articles relating to a variety of used boats that have been put up for sale are available in the website http://www.unitedyacht.com. Another website called the United Yacht also provides a number of links relating to the sale of the rental boats.

When selling a rental boat Business Management Articles, it is suggested to be descriptive while putting up the boat for sale so that prospective buyers will have a good idea what to expect.

There are many ways to fulfilling your dream of owning a poweryacht. Not every one can buy a new yacht outright and few people can even afford to have a poweryacht financed by a bank or financial institution, simply because the risks are many and guarantees too few. So if you cannot go in for a new yacht then what are the other ways you could realize your dream of owning a yacht? There is the used poweryacht market, but even that could be out of your budget, there are the poweryacht repo auctions that could land you a fabulous deal of a lifetime.

Yacht auctions are not as few and far between as many people would have you believe. The crux of the matter is knowing when the power yacht repo auctions are going to be held and where. It is not like they are a regular feature on ever colander. Many poweryacht repo auctions are mentioned as advertisements or news items in the papers many are kept a secret till the last minute. This is because the people who know about it and want to bid would like the least competition they can get at the auction. So you will have to follow every bit of information about power yacht repo auctions if you want to get the best deal on a power yacht, because this is the one place you could make a steal, as the saying goes.

If you have some contact in the marine bureaus or someone that works on the docks you could be intimated on the next poweryacht repo auction and the kind of yachts that are going under the hammer. Marinre bureaus usually auction poweryachts that they recover for non payment of dues among other reasons. Government agencies such as the coast guard and insurance agencies apart from financial institutions are also a good place to find some good deals on yacht auctions. These agencies recover yachts that have either been claimed by insurance or banks due to non payment of installment dues. yachts from Repo auctions can be purchased for some very good prices.

Then there are the omnipresent Internet search engines where you can get a lot of information about poweryacht repo auctions. Even then if you do manage to find a good auction there are a few thing s to keep in mind. Many auctions have a set of rules and start with a reasonable bidding price. The price will be driven by the crowd, the type of yacht and the auctioning agency. So do not expect miracles at the auction.

Never base your bid on your fantasy for owning a poweryacht. You should bid with due diligence and also do your research about the yacht you want to bid on. Attend the repo auction preview before the auction. Have a close up look at the yachts that are gong to be auctioned then decide which yacht you would like to bid on. Examine minutely the various aspects of the yacht like the cost of repair if any, and the cost of paper work like registration and taxes. Then decide on a maximum amount you will bid and hope for the best.

There is one way to advertise a business or an event and that is using boat wraps, because not only other boaters will take notice but people driving by in vehicles will also take notice of the offshore boat graphics.

Boats are one of the most noticeable crafts even to the auto driver as they zip by in the water; the thought of the freedom and fun the boaters are having makes them look. But, when they are boats with racing boat decals people really take notice. This is because marine wraps work the same way that vehicle advertising does.

This is why it pays to advertise with vinyl graphics because people take notice and those people can be potential customers that will remember a custom graphic on a vessel. This has become a common way of advertising for some trucking companies, city buses and taxicabs. People even watch for certain vehicles that have graphics because they like the way the design looks and that is what an advertising campaign is all about.

When using boat graphics they can advertise businesses, boat tournaments and other water events. With boats the vinyl boat graphics are not permanent so when it is time to trade the boat in or sell it, the graphics can be taken off leaving no paint damage. That means the boat has actually been an investment in a business rather than just for water sports and that can be a business deduction.

The boat graphics are colorful to be eye catching and they are also made of material that will hold up to what the water can do to a craft making it a very cost effective way to advertise.

Looking at racing boat graphics is something that other boaters will do just like the person in the vehicle and for that reason it is a very effective way to run an advertising campaign. The whole idea of running an advertising campaign is to draw in business and when its in the form of a vinyl boat graphic it is not something that will go unnoticed like many other forms of advertising. Today even billboards do not get the notice that they once did and one reason for that is because they are not in front of the eye but above the eye. This is not the case with a boat graphic, they are right in eye view and that means that more eyes will be seeing the advertisement than if it was on a billboard.

Article marketing has captured the imagination of many striving to earn a dollar online over the past 12 months. It’s simplicity is an appealing alternative to some of the more technical aspects of internet marketing.

One of the best learning environments online, Portal Feeder 2.0 preaches the importance of resisting the “too good to be true offers” which inundate our inboxes everyday and learn to build a business with
a solid foundation.

Some of these techniques may work for a short time however, nothing beats solid long term building strategies which can withstand sustainability issues in time.

Article marketing should form part of your overall strategy and done right, can generate tons of free traffic to your sites over a long period of time.

But is it a simple process? How are you doing with your article marketing? Are you getting the traffic you thought you would and are people clicking through to your site from your resource box?

These are all valid questions and ones you should consider carefully before spending the time and effort on crafting an article on your chosen topic. After all, why waste the time and effort in producing an article if it’s just going to become another “square byte” of wasted real estate online.

Let’s take a look at some of the deadly article marketing sins you should avoid to ensure you achieve ongoing success with your writing online.

1. Craft a compelling title. Include your keyword in the title usually at the beginning.

2. Depending on how long your keyword or keyword phrase is, include it twice in the title. You could also use your main keyword and a synonym but again, watch the length of your title.

3. Avoid writing your article in the me. Do not use “I” statements. This is especially important when crafting an article aimed at directing a reader to your resource box to view your offer.

4. Avoid writing the article as a news story. If it’s an offer you have, the article should be offering a solution to a problem. People go online looking for solutions to problems and if you don’t have it, they will quickly move on.

5. Avoid using a closing paragraph. A good article marketer will end his piece in such a way that the resource box will act as the closing paragraph.

6. Your resource box must be compelling enough for people to want to click through to your site. Mention benefits in your resource box.

There is pain in the online learning process and it’s one of reasons over 90% of hopefuls don’t make it. If you have the patience and work ethic, then success will come your way. Articles have the ability to act as your own personal team of salespeople for a very long time.

Once you master the skill of article marketing, you’ll be light years ahead of most of the struggling internet marketers online today.

Thinking of starting a blog? Here are a few things you should think about when choosing a platform:

Author: tech n roll
The choice of a blogging platform is one the most important decisions a blogger/webmaster will make in the course of their business. Blogging can be made easier or more difficult, depending on the decision that is made. For example, user-friendly features must be carefully balanced with those techniques that are being utilized to the specific weblog site. This is but one aspect of the decision to be considered.

Customizable platforms allow for greater leeway in the formation and production of a blog site; however, a novice blogger/webmaster may want to start off with a program that is easier to navigate and use, then upgrade to a more complex platform as experience is gained. Veteran blog site owners may wish to go ahead and use a customizable platform in order to project the creativity and originality they desire. Using a simpler program may prove frustrating to an “old hand”.

No blogging platform can be considered the “best”, because each platform’s “personality” and individuality is as varied as those using the platforms. There are advantages to having numerous choices, as it is likely that there is a specific platform available to meet the needs of each and every blogger.

Bloggers/webmasters should keep the goals and priorities of their weblog site uppermost in mind when searching for the right blogging platform. Reviews of platforms should be taken in context with the reviewer’s position. What may look like a negative review to an experienced weblog owner may be exactly what the beginning weblogger needs.

Digital cameras and the internet have revolutionized the world of photography. No longer is expensive equipment and years of experience required to make money taking pictures. Now all that is needed is an entrepreneurial mindset and a little determination. Here are the basics of starting your own mini-photography franchise.

-Invest in the Right Equipment

The right photography equipment can not only improve the quality of your work, but it can also save you time as well. Even if you are working on a tight budget, you should not base your purchases solely on price. Look for products that offer the best value, which means finding those that provide the best features for the least amount of money. The most important equipment you will need is a camera, computer, editing software, and possibly a bag to carry everything in.

-Gather Samples and References

As in any business, you will have to provide your customers some proof that you are competent photographer. You can do this by building samples of your work and providing references of past customers. If you are just starting out, then offer to take pictures of friends or family for free. Combine these sessions with some artistic or outdoor shots to show a variety of your talents. Put it all together in a portfolio or brochure you can hand to your clients. Just don’t skimp on the quality since this is the first impression they will have of you.

-Market Your Services

Finding the best way to advertise can be difficult, especially if you are on a budget, but the key is to be creative. Start by designing your own business card with a memorable photo on the front. Pass these out to everyone you know and leave small stacks of them in public places. For mainstream exposure, use online classified sites that let you can post your services on for free. Of course a website is also helpful, and this can be done easily by building a blog. Some photographers also use their blog to post new photographs of their work.

-Develop a Niche

When you are first starting out, there will be a period of trial and error while you learn what sells and what doesn’t. Eventually though you should find some specific niches that you enjoy focusing on and that play to your talents. Since a lot of your customers will be looking for a precise type of picture, you can increase your sales by becoming an expert in a particular category. Some examples of niches include nature, sports, and business pictures. The key is to find a profitable niche that has very few competitors so that you can dominate it without much resistance.

Getting paid to take pictures is the dream of many amateur photographers, and it is certainly an attainable one. By treating your hobby as a business, you can build a supplemental income stream while doing what you love. Just remember to do your research and start slowly before you get too far over your head.

Is there an expert on effective meetings in the house?

For an upcoming online course we’re writing/creating over at InfoSource Learning (a leader in training solutions for 25 years), we’re looking someone who’s the hotshot of effective meetings.

He or she would be a person who’s taught thousands of business people, worked with Fortune 500-type organizations, and written a book or two on the topic.

Sort of the “Tom Peters of meetings.”

We need someone like this to be a “spokesperson” for part of the course.

Ideas welcomed and appreciated. Think this could be you or maybe someone you know? Tell us.

A new business model for ringback tones will be announced soon, word has it that 15th November is the official announcement to all record labels, content providers and the public. This is from a very heated and long negotiation between RIM and the local Telcos. The issue was subscription sharing of the service and hopefully, this should resolve some issues pertaining to the constant struggle of RIM to fight for a win win deal.

Initially, users would have to pay RM3.00 per ring back tone/ Caller ring tone and another RM3.00 for the subscription fee, regardless of how many ring back tones that users have purchased.

I heard that the prices of RBTs will drop to RM2 and users have to pay a subscription fee of RM1 for each subsequent song, so say you purchased 3 RBTs, u need to pay RM 4 per month. To be honest, I’m not really sure how far this is correct, but according to the Telcos this would ultimately mean a more steady revenue stream for content providers and record labels.

I shall keep you guys posted!

I arrived in Melaka at around 4 PM, and no, I didn’t manage to get a room in A Famosa as it was already jam packed after the 3rd week Global Gathering was announced. I brought some spare T-shirts and a lot of bottled water, as I received advice that one bottle costs around 12 bucks at the event. Crazy. So I went straight to the entrance and cleared myself in, in wasn’t too hard though, despite the strict security check, everything was good as fried chicken.

The weather was hot and icky, but the worst thing was the wet and muddy ground. I was lucky to bring a pair of flip-flops. People were starting to buzz around the area, inquisitive and very eager to party, but Lo! getting all excited under the hot sun is not a very good option. There were booths of all sorts, I was nearly in tears when I saw the ‘DjDownload’ and ‘Metamobile’ logo on all of the banners and buntings at the event. I heard that the flyers are going to be distributed in Don’t Panic! packs so I assume it’s sorted.

I went to the Global Arena first. Nothing. I believe that all the action is scheduled for the night. Godskitchen was quiet too. Only TQX, Freedom and the Foambar was alive. People were a bit curious about the foam bar. Tsk. The party is starting to warm up as inquisitive punters started jumping into the foam

Fast forward.

The event that night was really good I should say, watching The Shapeshifters and Sander Van Doorn was just mind-blowing, the only setback was the muddy ground and very stale tasting burgers which costs RM5. Dagnamit!

I ended up really sloshed and bugged the Don’t Panic! crew to offer me free shelter and some chocolate marshmallows at their tent. Hustling at it’s best! So we ended up chatting for a couple of hours and watching people getting drenched in mud, pissing off the authorities and looking at cigarette chicks in skimpy skirts. Ah well, I suppose everyone was having fun in their own way.

There were huge human catapults of some sort beside the other tents, watching em being shot to the sky really makes me nervous. Yeah, I have to admit, I am not a fan of extreme activities.

We headed back to KL around 3.30 AM. I was too tired to drive so I handed the wheel to my girl, and before I knew it, we arrived at my condo. Well, I dozed off, and my girl was kinda pissed..so yeah..

I dreamt of people looking like glow sticks. So scary.

A part of the discussion on “Morning Joe,” during this morning’s discussion on last night’s debate was how Barack Obama looked different. Joe Scarborough, the host of the show, asked quest and Washington Post Editorial Board Member, Jonathan Capehart, if he noticed how Obama looked different. Capehart, a light brown skinned, well dressed bipartisan, mentioned, he was not sure if it was the lighting, or if Barack had gotten a tan in Florida, but Obama looked darker.
Capehart was concerned but he noticed from other angles the darkness was not as bad. I am a very dark skinned black American, I thought, wow, I would not have a chance under those conditions. Scarborough, pointed out the darkness was not as bad as the OJ, News Week covers, where OJ was made to look menacing.
The rest of the panel was very uncomfortable, but I had to wonder. Me, Michael Jordan, Clarence Thomas, and about 85% of Black Americans that are darker than Barack would not be able to run for President. Even if we had the plan to solve the financial crisis, end the war, find a cure for Aids and provide everyone’s life with bliss, we would be viewed as too black.. Is this true?
Obama is half white. His mother was a white woman. What if he had married a woman that was white? Would he still be a Presidential candidate, same man different wife? Help me out, should Barack stay out of the sun. Does his color make him more acceptable to whites, how about to blacks? If he had married a white woman, would whites support him more or less? How about blacks?
These are explosive topics and many may fear commenting, but if it is on a newscast debating the debate for President, we should be able to discuss it here. We the people who are darker than blue, have to compete in this society as well, are dark skinned blacks at an advantage or disadvantage?
Lastly, now that Sarah Palin has interviewed twice, are you sure you trust John McCain’s judgment? As John McEnroe would say, “You can’t be serious!”

I came across an article by Suzie and Jack Welch, former CEO of GE. Being in the business of recruitment, I often see candidates miss understand the job market and what it takes to compete. This article expresses very well, the sense of loss when a job unexpectedly ends, or your company is sold. Their advice is great. I hope you enjoy and have some comments to contribute. The post is in response to a question asked.

Given this week’s events, what advice would you give to the employees of Merrill Lynch and Lehman Brothers? —Courtney Ellison, Amherst, Mass.

First, we’d like to say that we’re really sorry for their sense of loss. Being acquired and getting laid off are experiences that can hit you like a death in the family. The shock, sadness, anger, and confusion can make you want to enter into a period of protracted mourning.

Such a response is only normal.

But career-wise, such a response can be disastrous.

Look, we’re not about to blithely tell Merrill’s (MER) roughly 60,000 employees and Lehman’s (LEH) 22,000 to put on a happy face and get on with life. A massive earthquake just struck Wall Street; people will be reeling for a while.

But to the employees most directly affected, we are saying that you can’t reel too long. At Merrill, people need to quickly adopt a No Resistance Mind Set. And at Lehman, they need to act fast to avoid the Vortex of Defeat.

Merrill first. For almost a century, it has been independent—and so proud that brokers were known to call themselves “the thundering herd.” Now it’s a subsidiary of the mammoth Bank of America, the result of a rescue mission.

How do you suppose Merrill’s employees will react? It’s true that BofA has demonstrated a competency for M&A integration. Even so, if Merrill’s people are like most acquired employees, some will balk. BofA’s culture, processes, leaders, and way of doing business will seem different—and wrong. Everything at BofA, basically, will seem worse than the good old days at Merrill, and many employees will say so, if not out loud then with their attitudes.

No, no, no! If you’re a Merrill employee—or work for any acquired company—understand one thing. Your new owner has limited patience for pouters. They know M&A resisters slow work down and that their cynicism poisons the waters. That’s why, when it comes to sorting out their new roster, the vast majority of acquirers choose buy-in over brains. Superstars may get a free pass, but if you’re a “regular” type—say, a middle manager with a good track record—you may now be one of two people fighting for your job. Your margin for error, as BofA seeks to realize $7 billion in “synergies,” is smaller than ever.

So to Merrill employees, we say: Honor your past, but put it away. Rescind your claim on victimhood, join the BofA team heart and soul, and work hard for its future. It’s your best chance that BofA’s future will include you.

Lehman employees face a harder challenge. They’re looking for jobs in a shrinking industry flooded with experienced applicants, the kind of stymieing situation that can easily put people into a downward spiral of self-doubt.

The best antidote to this Vortex of Defeat is immediate action. You may want a breather to take stock of your life, but any delay on your part only allows other job seekers a head start on the opportunities available. You need to draw on your reservoir of self-confidence and start chasing leads today.

If you’re thinking, “Fine, but Wall Street isn’t hiring,” we hear you. Which is why our next piece of advice is to broaden your search, on both the job content and geography fronts. A few years back, we encountered a group of laid-off engineers in a medium-sized Midwestern city who had spent a year in vain looking for work. Their industry had largely left the region, but they all wanted jobs like their old ones. Worse, they’d put relocation off the table.

Sometimes, of course, “downsized” people can pick up where they left off, but rarely does that happen after disruptions on this scale. To move forward, Lehman employees will need to think expansively and creatively about starting anew. That’s scary, yes. But so is the option of waiting around for a “good fit” that may never come along.

Now, we don’t expect Merrill or Lehman employees to readily embrace our message. Who wants to be told to let go of their understandable anger? But uncommon times call for uncommon solutions. Very reasonably, this week’s tumultuous events may have you hungry for the past. We urge you to thirst for the future instead.

Tell us.

First, stop crying...
Gary Vaynerchuk is the zany broadcaster from WineLibraryTV and a successful discount wine retailer. Small Winery Marketer reports on one of his recent business presentations. His call to action should be heard by all small cafes and restaurants: "If you’re not using new media to promote and control your brand, you’re going out of business, but you don’t know it. Your margin is gone! Ghost!" His declaration that winemakers need to have a blog and update it daily, should be active on Facebook and MySpace, and should patrol other wine blogs contributing comments and “being part of the conversation” led some to wonder where all the time and energy was to come from. “First step, stop crying.” Vaynerchuk said. “Don’t be scared. It’s your business.” Taking risks, putting your self out there has virtually no downside, he said. “The people you think control the game are about to lose it anyway,” so you’re better off taking control of your message. He went on to say that being genuine and truthful made up for not being a great writer. He warned against thinking that daily observations from your vineyard or winery weren’t important enough to interest people. If you tell people about yourself and don’t preach or sell, they care, he said. “You need to go direct to the consumer,” he said. “if you don’t, you’re dead.” You either spend money, or time to promote your product. Five years ago, there were no free marketing options (blogging, Facebook etc) except talking face-to-face - spending was the only way to reach a crowd. Now, more and more consumers trust their fellow eaters on Yelp and Eatability before they trust the authority guidebooks. Participate or wither...

If you have ever worked in a business office, you are probably familiar with this term, previously known as teleconferencing. More Dangers in Negotiating by Email

Over at IP ADR, we warned against using email to negotiate because the social scientists tell us that it is "profoundly anti-social," i.e., we're less generous when we respond to an offer via email than when we're negotiating face to face.

Today, Scientific American warns us that emailers tend to deceive one another more readily than do those who use pencil and pad -- see Business, Lies and Email here, excerpt below.

E-mail is often a rather casual form of communication.  Language is more informal and grammar, well, it ain’t a priority.  Now comes a study that finds that people tend to lie more in email than when writing with pen and paper.  This research from DePaul, Lehigh and Rutgers Universities. . . . .

New California Case on Mediation Confidentiality and Recovery of 1717 Attorney Fees

How do California's Courts protect mediation confidentiality?  Let me count the ways. You can't impliedly waive the protections of Evidence Code section 1115 et seq. nor be estopped from raising them.  Their walls will not be breached by allegations of fraud or any lesser form of bad faith.

Still, litigants keep on trying.

The same week during which a Petition for Review of the recent Thottam opinion went up to the California Supreme Court ("the big print giveth, the small print taketh away) yet another appellate opinion came down telling us that you cannot be judicially estopped from asserting mediation confidentiality -- this time in connection with a party's request for an award of attorneys' fees under Civil Code section 1717.  The case is  Rael v. Davis, yet another estate dispute not entirely unlike Thottam.

(here, by the way, is the Thottam Petition for Review)

I continue to find that 90% of the attorneys whose cases I mediate do not know:

  1. how to protect their mediated deal by complying with the requirements of Evidence code section 1123; or
  2. just how strong the confidentiality protections are in California, both before and after the Supreme Court's Simmons v. Ghaderi opinion.

I will say it again:  litigators settle cases at mediation at their peril if they do not stay current with the torrent of cases coming down from the Supreme Court and Courts of Appeal on the issues of enforcement and confidentiality.  Fail to properly document the settlement agreement, have it blow up in the parties' faces, follow it with litigation over the agreement that was supposed to settle the underlying litigation and you've got an explosive mixture leading straight to your malpractice carrier's front door.

Hey!  Be careful out there!

Even if the Property Index online service is generally viewed as a newcomer corporation, incorporated in March 2007, they were very swift to become experts. In point of fact a quite down to earth corporation entirely focused on catering to any individual determined to sell real estate in most areas of the world. What they agree to do is lend you a hand to locate bang-on what’s needed swiftly and, to boot, without pain.

Property is at your fingertips in most popular areas of the world nowadays, one of the fanciest areas being estate available in Italy. It should be no big challenge to tick off the wonderful properties available in Italy, the explanation for hunting for real estate here is a combination of the houses and apartments available and the sensational opportunity of spending your life amid such a bubbly, animated and bouncy populace. This is one of the truly well-liked markets nowadays, and with the gorgeous landscape and great weather surrounding you, how could you be wrong! Property in Italy is very rich in history and culture, this realm of the world has always been home to a number of cultures.

Property Index are specialists for property in Italy, view the site to see the different properties.

Only 25 or 30 years ago you’d find a mere dribble of Britons looking for properties in Italy. Just ask any person who has emigrated to Italy and they’ll back it up. Plenty of people would tend to view it as a basically irrelevant fashion and others tend to view it as a approximating to a fixation. Buyers actually repairing to this area may range from newly weds looking for a life perspective to OAPs looking to have a break and enjoy themselves. Note, though, that you may have to deal with setbacks when purchasing properties abroad - there are, of course, 100s of steps to bear in mind be it when strategising, inspecting or finalizing the deal. If you only miss one single minor procedure it may escalate sizable setbacks plus, of course, critically, a financial trouncing.

As you will probably have supposed with this sought after location, properties can be quite high-priced in this region and that’s basically due to the broad market pressure. Yet, homebuyers are quite spoilt for choice in an area so rich in bright topography and good scenery. It’s really got all, stock and barrel, one may imagine and more.

“All the prices have already risen, it would be ridiculous if they rose even more. Of course they freeze them now,” she said. -AP mexico.vg

McCain discredits Palin's remarks. Why don't they count? Is he being sexist?

When trying to distance his campaign from a contrary statement made by his running mate, John McCain chose to dismiss her like she was inconsequential. Like she was just "chatting" with some guy. Then he goes on to speak for her, to say what she really meant. I think some woman might recognize this tactic to diminish. It sounded sexist to me.

With my return to the US and being in the same timezone as most E2.0 bloggers (save my Australian blogging mates) I was hoping to blog more here on SocialGlass. But I’ve been busy writing a book, doing a startup on the side, and managing developers at my new full-time gig. But, I assure you, things are tapering down and within the next few weeks I’ll be back at it.

I just had a good conversation with Sam Lawrence about Clearspace 2.0 that I’ll be blogging about next week. I’m also hoping to divulge a bit more about what I’m doing with my current employer and my new-found passion - agile development.

I safely arrived in Colorado last night.  It’s been 1 year since I’ve been in the US.  I immediately noticed how festive the US is around the holidays. Carols were playing in the LA airport and people said “merry christmas” to me.  This doesn’t really happen in Australia, where if they said it they’d prefer “happy christmas” instead.  It’s also pretty cold in Denver (at least compared with how hot it’s been in Melbourne this past few weeks).  And I had my first Chipotle burrito since last December for dinner tonight.

What I’ve noticed immediately is that most blog and twitter updates now happen throughout the day.  In Australia it was like reading the newspaper, where when I got to work most of the blog posts and twitter updates from my US counterparts had been completed already, so I’d spend 20 minutes or so catching up on the “news”.  Now my reader constantly has updates.  I’m not sure which way is better actually.

Anyway, I’m hoping to visit more conferences now that I’m in North America and meet some of my blogging friends in person.  I might look into heading to the FASTForward conference this year to get me going.

    It’s good to be back.

    Clio: More Terms of Service
Lawyers read contracts.  It’s akin to swearing like a sailor … just part of the deal.  And having heard everyone’s doing it, the FutureLawyer has begun scrutinizing terms of service agreements himself, before checking the “Accept” box for installations.  Like a healthy early-adopter, he found a well-recommended beta service, and thought he would give the [...]

Lawyers read contracts.  It’s akin to swearing like a sailor … just part of the deal.  And having heard everyone’s doing it, the FutureLawyer has begun scrutinizing terms of service agreements himself, before checking the “Accept” box for installations.  Like a healthy early-adopter, he found a well-recommended beta service, and thought he would give the free trial a shot.

I can appreciate his hesitation as he launched into registration.  I’m thinking he’s thinking, “what kind of language will be in the terms of service to give me comfort that I can entrust these people with my day-to-day practice, my livelihood, and ultimately, even my good standing with the state bar.”  But, I nearly digress.

So, there’s Rick, excited about trying out this new software as a service (Clio, by Themis Software), and he takes a few moments to scan the terms for how well he might be protected in the event something goes wrong. Then he comes across just what he’s not looking for (what’s a good antonym for glee).  In his words, here are

[j]ust a few of the gems on the hit parade: “1. You expressly understand and agree that Themis Software shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Themis Software has been advised of the possibility of such damages), resulting from your use of the API or third-party products that access data via the API. 2. Abuse or excessively frequent requests to Clio via the API may result in the temporary or permanent suspension of your account’s access to the API. Themis Software, in its sole discretion, will determine abuse or excessive usage of the API. Themis Software will make a reasonable attempt via email to warn the account owner prior to suspension. 3. Themis Software reserves the right at any time to modify or discontinue, temporarily or permanently, your access to the API (or any part thereof) with or without notice.”

What does the FutureLawyer do; how should he react?  The suspense is killing you.  You’ll have to read the punch line at FutureLawyer.  (You didn’t think I would mooch his ENTIRE post, I hope; but here’s a hint: it ends with sarcasm.)

And for those following a now-stale thread on these premises: know that neither Erik Larson nor anyone at Adobe has lived up to their “we’ll get back to you” promise regarding the new Acrobat.com terms of service.  You’re stunned.  I know.  Apparently, we gave way to more recent posts showing up on the Google Finance page for ADBE.  (Yes, I would feel bad if I suspected they just paid us a little lipservice while shareholders were watching.)

In 2003 I sold my Wi-Fi Hotspot company to Dutch telephone operator KPN. One of the first things we did (we = me and my partners Koen & Caspar) after we signed the contract was to install HotSpots in the lobby of the main KPN building. The boxes we hid the Wi-Fi equipment in were shaped in the form of our logo. I was very proud to see them installed there! Then, after a few months, we parted ways and KPN completely restructured the company once I was out of the picture. I heard that most of the people working there were replaced (or left) by KPN people and they changed the technical infrastructure too switching to ‘Off-the-Shelf’ parts instead of the custom made Wi-Fi Access points we developed ourselves. All of this made perfect sense to me and I had no problem with it but you can imagine it still feels awkward to see the company you built change into something completely different.

You can imagine the satisfaction I felt when I got an email from an old friend at KPN who took this photo in the main lobby of KPN last week:

Yep, our original Wi-Fi hotspot, in the case I designed with the logo I designed is still active and visible to everyone visiting. Makes me proud…

    V3.com VS TwitterCounter.com
In 1997 I started working on an idea I had for a redirect service based on domains from Tonga. I registered come.to, surf.to and welcome.to and together with two friends (Hans-Poul and Eric) we started a company called V3.com. We ended up selling our company in 1999 to Fortunecity. In 1997 I started working on an idea I had for a redirect service based on domains from Tonga. I registered come.to, surf.to and welcome.to and together with two friends (Hans-Poul and Eric) we started a company called V3.com. We ended up selling our company in 1999 to Fortunecity.

That is a short version of that story as I have talked about it a lot before. What I wanted to talk about is how similar V3.com was to TwitterCounter.com. Don’t get me wrong: they served completely different purposes and technically they were very different too but there are a few very distinct similarities which I would like to show you:

    V3.com TwitterCounter.com
    TwitterCounter for @bomega
Yes, both services have a button. With V3 only people who were really happy with the service (a lot!) added this button to their homepages. At TwitterCounter you could say that the button IS the service so that makes this viral growth aspect even more powerful.
generated money from advertisement generates money from advertisement
Well, that sorta makes sense right? The funny thing is that most people (now and then) don’t realize how powerful this service is when it comes to advertising. Both services are pretty low maintenance and with every new member you get a few extra new ad views a day. All you have to do is increase membership and with it ad views will increase as well.
Disgarded as ‘funny but not a real business’ Disgarded as ‘funny but not a real business’
Not that I’m complaining here but this one keeps amazing me. When I was working on V3.com I had to defend myself all the time. When I explained the concept I would either get a blank stare or people would say “You are out of your mind, this isn’t going anywhere, who would be interested in THAT’. I never understood that people couldn’t see the potential for the service. Same goes for TwitterCounter. Yeah, it’s a funny little thing I threw together in a few hours. But with every new member I get another banner, and link to TwitterCounter generating a few more visitors a day, generating a little more advertising revenue, and new members. Repeat that last sentence 10 times and you might get an idea of the potential behind TwitterCounter.
Weak spot: Domain prices? Weak spot: Twitter future?
Another similarity is that there was a big weak spot that is easily recognizable in both services. At V3.com it was clear that as soon as domain names would become really cheap we wouldn’t really have a business left. At TwitterCounter I am completely depended of Twitter. If they stumble, close down, change their policies and become less open, or even lose their market share because of the Next Twitter I’m gone.
    Excitement: high! Excitement: high!
I’m really excited about Twittercounter in a very similar way as I was with V3.com. It is very exciting to browse the web and just randomly see your own product featured on blogs and websites. My partner in V3 (Hans-Poul) once told me he was driving around in his car and felt slightly depressed for no particular reason. When he stopped for a red light he looked out of his side window, through the rain, and saw a sign on a restaurant. In big yellow letters they had printed “Surf.to/Shoarma” on their window. He felt a lot better right away! I get a similar feeling when I brose to Leo Laporte’s website and see a TwitterCounter (leolaporte has 51,738 followers!) displayed prominently.

Ok, I hope that gives you some insight into what I liked about V3.com and currently like about TwitterCounter.com. To finish this post I will answer a question that you might have right now: Do I think that I will sell TwitterCounter for a lot of money (or shares) just like I did with V3.com?

The answer: I don’t know, but lets find out…

Fabb: My first house starts coming together
Today, my first-ever report on my (maybe) new prefab company, "Fabb;" I've been spending the week building my first-ever house, in fact, and thought I'd share both photos and notes from the process today.

Oh Lord, I've been landshopping again (part 2)
Today, part 2 of my recent report on landshopping again in the grid, this time for a much larger headquarters for my blog than before (1,500 square meters versus 500). Should I buy on the mainland? Should I buy on a private island? So many choices! Read some of the pros and cons by clicking through.

    Gridhopping: Luxor Temple of Art
Today, a small report and photo essay from the recent opening of the Luxor Temple of Art.

Yes, that is the same dress as last timeReward good behavoir and help a lady out with a proper wardrobe.

The last time I lived in a District where my Representative was even more liberal than me was when I went to school in Dennis Kucinich’s playground — but no one beat Jim Trafficant for sheer wackyness where I grew up. Both of them made my other reps, Lou Stokes and Stephanie Tubbs-Jones, seem downright mainstream. Now Marcy, god love her, completes the cycle — leading me to ever more DFH behavior. I’ve never had occasion to write one of them to stop being a pussy or angry that they were in the pocket of someone with a big fat checkbook. Invariably they’ve inspired me to remind my kids (and you) that some of the most dangerous enemies this nation has live right here, selling snake oil.

Ahh, screw it. I might as well admit right now I’ve been known to say “Go Blue!” on occasion, just to piss off my father-in-law; and actually have a Michigan cap buried in my closet under all the required Ohio State gear all Ohioans are issued at birth. Living in THE most liberal districts in Ohio sure has skewed my take on my fellow Buckeyes — and I even spent a summer at OSU a hundred years ago taking classes, chasing girls and searching in vain for decent pot. (All the good stuff was in Athens, home of my beloved yet eternally hopeless Bobcats, the only blue county south of Columbus.)
